These Terms of Service ("Terms") govern your access to and use of triumphrealty.com (the "Site") operated by Triumph Realty LLC ("Triumph Realty," "we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Purpose of the Site

The Site provides information about Triumph Realty's brokerage services, including restaurant leasing, retail leasing, tenant representation, landlord representation, and pre-lease site review. The Site is intended to introduce our services, share market information, and allow prospective clients to contact us.

Information presented on the Site is for general informational purposes only. Nothing on the Site constitutes a binding offer, an agency relationship, legal advice, architectural advice, engineering advice, or a representation that any specific space is suitable for any specific use without independent verification.

Brokerage Services and Affiliated Entities

Triumph Realty LLC is a licensed real estate brokerage in the State of New York. Our license number, principal broker, and office of record are disclosed on the Site and in any agreement entered with a client.

Where appropriate, clients may be introduced to separate affiliated companies that provide architecture, compliance, construction coordination, property intelligence, or regulatory review services. These services are provided under separate agreements with those entities. No client is required to use affiliated services as a condition of brokerage representation by Triumph Realty.

Triumph Realty does not provide architecture, engineering, construction, inspection, or legal services. Any references to these activities on the Site describe services performed by third parties or separate affiliated entities, not by Triumph Realty.

Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to use the Site to violate any applicable law or regulation, infringe the rights of others, transmit harmful or malicious code, attempt to gain unauthorized access to any portion of the Site or related systems, scrape or copy content for commercial purposes without written consent, or interfere with the operation or security of the Site.

We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.

Submissions and Uploaded Content

When you submit information through a contact form or upload files such as listing packages, floor plans, lease drafts, or photographs, you represent that you have the right to share that information and that the submission does not violate any third-party rights or confidentiality obligations.

You grant Triumph Realty a limited, non-exclusive license to use submitted information for the purpose of evaluating the inquiry, providing brokerage services, and communicating with you. We do not claim ownership of your submitted content. Files you upload are reviewed by Triumph Realty only and are not shared with affiliated entities without your written consent.

Listings and Market Information

Property listings, market data, and other information presented on the Site are believed to be accurate but are not guaranteed. Listing details, asking rents, availability, and condition are subject to change without notice. Prospective tenants and landlords should independently verify all information before making decisions or entering agreements.

Photographs, floor plans, square footage, frontage measurements, and Certificate of Occupancy references are provided for general reference only and should be confirmed through official records and independent inspection.

Triumph Realty LLC supports the principles of the federal Fair Housing Act and applicable New York State and New York City fair housing laws. In no event shall Triumph Realty's total liability for any claim arising out of or relating to these Terms or the Site exceed one hundred dollars ($100), or, where prohibited from such limitation, the minimum amount required by applicable law.

Indemnification

You agree to indemnify and hold harmless Triumph Realty LLC, its officers, employees, agents, and affiliates from any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another party.

Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
