Second-Generation Restaurant Space in NYC

Triumph Realty helps tenants find second-generation restaurant spaces in NYC and verify the existing kitchen infrastructure before a lease is signed.

Is a 2nd Generation Restaurant Space for Lease Ready to Open?

A 2nd generation restaurant space for lease is a space that a previous tenant built out and operated as a restaurant. It may come with a hood and exhaust duct, gas piping, a grease interceptor, restrooms and kitchen plumbing already in place, which can reduce buildout time and cost compared with building a kitchen from scratch.

Existing equipment is not the same as approved equipment. The hood may not match what was permitted, the gas may be shut off, and the Certificate of Occupancy may not cover the seating the new concept needs. Triumph Realty LLC, a licensed NYC real estate brokerage focused on restaurant and street-level retail leasing, checks these items before a tenant relies on what the last operator left behind.

What to Verify Before Relying on Existing Infrastructure

Triumph Realty asks for the records below on every second-generation space. Each item is based on rules published by NYC agencies, and the tenant's licensed professionals confirm the technical details.

  • Certificate of Occupancy. The CO states the legal use and occupancy and can be looked up by address in DOB BIS or DOB NOW. A change in use, egress or occupancy needs a new or amended CO, and DOB will not issue one while applications or violations are open on the property.
  • Place of Assembly status. A restaurant with 75 or more people needs a DOB Place of Assembly Certificate of Operation and an annual FDNY Place of Assembly permit. A new seating plan or a new establishment name requires an amended certificate, so the previous operator's certificate may not carry over as is.
  • Hood and duct permits. The cooking exhaust system must be filed with and approved by DOB, and FDNY issues an annual permit to operate it. FDNY lists a system that differs from its permitted installation as a common reason restaurants fail the annual inspection.
  • Exhaust cleaning records. Hoods, ducts and fans must be cleaned by an FDNY-approved company, generally every 3 months, and the company places a decal on the hood. A yellow non-compliant decal means the cleaner found a deficiency.
  • Fire suppression service. The automatic fire extinguishing system over the cooking line must be inspected, tested and serviced by a licensed master fire suppression piping contractor at least once every 6 months.
  • Gas service. Gas piping work must be done by a Licensed Master Plumber, and restoring gas that was shut off requires a DOB filing. The utility can only provide gas after FDNY inspects the hood fire suppression system and DOB inspects the gas cooking equipment.
  • Grease interceptor. DEP requires a properly sized grease interceptor. If an existing unit is too small, DEP inspectors can order the owner or operator to install the correct one.
  • Accessibility. Restaurants are public accommodations under Title III of the Americans with Disabilities Act. Both the landlord and the tenant are covered, and the lease can set who is responsible for which items.

How We Vet a Second-Generation Space

01

Pull the public record

We pull the Certificate of Occupancy, Place of Assembly records, and open DOB jobs and violations for the address.

02

Request the kitchen documents

We ask the landlord for the FDNY permit, hood cleaning records, fire suppression service records and grease interceptor history.

03

Walk the space with your team

The tenant's architect or engineer and licensed contractors compare the hood, duct route, gas and plumbing with the records.

04

Put findings into the lease

Gaps become lease items, such as landlord work, delivery condition and the time needed to reach approvals.

What Is Included

Our second-generation space review may include:

Search for second-generation restaurant spaces
Shortlists of former restaurant spaces by size and budget
Review of the existing kitchen layout against the new concept
Comparison with first-generation and retail restaurant space for lease options
Buildout feasibility review for kitchen changes
Zoning, legal use and open violations check
Certificate of Occupancy and Place of Assembly review
Landlord requests for FDNY permits and service records
Lease terms for landlord work and delivery condition
Coordination with the tenant's architect and licensed contractors
Neighborhood and nearby use review

Why It Matters

A second-generation kitchen can shorten the path to opening, but only if what is there is legal and working. A hood altered without approval, gas that is shut off, or a CO that does not support the planned seating can turn a quick turnover into a full permit process.

Finding this before signing gives the tenant room to negotiate landlord work, ask for a different delivery condition, or pass on the space.
